1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen, die Sie als Verbraucher oder Unternehmer über unseren Onlineshop [www.monared.com] tätigen.
Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, wir stimmen ihrer Geltung ausdrücklich schriftlich zu.

2. Vertragspartner

3. Angebot und Vertragsschluss

  • Die Darstellung der Produkte im Onlineshop stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Bestellung.

  • Durch Anklicken des Buttons „Jetzt kaufen“ geben Sie ein verbindliches Angebot ab.

  • Die Bestätigung des Eingangs Ihrer Bestellung erfolgt per E-Mail unmittelbar nach dem Absenden.

  • Der Vertrag kommt zustande, wenn wir Ihre Bestellung per E-Mail annehmen oder die Ware versenden.

4. Produktion & Versand über Printful

  • Physische Produkte werden On-Demand über unseren Partner Printful produziert und direkt von Printful oder deren Versandpartnern geliefert.

  • Die Produktions- und Lieferzeiten können variieren und liegen außerhalb unseres direkten Einflussbereichs.

  • Für Zollgebühren, Einfuhrabgaben oder ähnliche Kosten, die bei internationalen Lieferungen anfallen können, ist der Käufer verantwortlich.

5. Digitale Produkte (z. B. Songs, Downloads)

  • Bei digitalen Inhalten erlischt das gesetzliche Widerrufsrecht, sobald wir mit der Ausführung des Vertrags begonnen haben und Sie dem ausdrücklich zugestimmt haben (Art. 16 lit. m EU-Verbraucherrechterichtlinie).

  • Digitale Produkte werden nach Zahlungseingang in der Regel sofort zum Download bereitgestellt.

6. Preise & Zahlung

  • Alle Preise verstehen sich in Euro (€) zzgl. Versandkosten.

  • Gemäß § 19 UStG erheben wir keine Umsatzsteuer (Kleinunternehmerregelung).

  • Akzeptierte Zahlungsarten werden im Bestellprozess angezeigt (z. B. PayPal, Kreditkarte, Stripe).

  • Bei internationalen Bestellungen können Währungsumrechnungsgebühren oder Bankspesen anfallen.

7. Lieferung

  • Die Lieferzeiten sind abhängig vom Produktions- und Versandstandort (Printful) und werden im Checkout angezeigt.

  • Lieferungen erfolgen weltweit, soweit keine gesetzlichen Beschränkungen bestehen.

8. Widerrufsrecht

  • Für physische Produkte gilt das gesetzliche Widerrufsrecht von 14 Tagen, beginnend mit Erhalt der Ware.

  • Ausnahmen:

    • Produkte, die nach Kundenspezifikation angefertigt werden (z. B. personalisierte Merch-Artikel).

    • Digitale Produkte, sobald der Download begonnen hat.

    • Unterwäsche und vergleichbare Artikel, sobald die Verpackung geöffnet wurde

9. Gewährleistung & Haftung

  • Es gilt das gesetzliche Mängelhaftungsrecht.

  • Wir haften uneingeschränkt für Vorsatz und grobe Fahrlässigkeit, bei Verletzung von Leben, Körper und Gesundheit.

  • Bei leichter Fahrlässigkeit haften wir nur für vorhersehbare, vertragstypische Schäden.

10. Datenschutz

  • Die Verarbeitung personenbezogener Daten erfolgt gemäß unserer Datenschutzerklärung.

  • Für Produktion, Versand und Zahlungsabwicklung werden Daten an unsere Partner (z. B. Printful, Zahlungsdienstleister) weitergegeben.

11. Urheberrechte

  • Alle Inhalte (Texte, Bilder, Musik, Designs) sind urheberrechtlich geschützt.

  • Downloads sind nur für den persönlichen Gebrauch bestimmt und dürfen nicht weiterverbreitet werden.

12. Anwendbares Recht & Streitbeilegung

  • Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.

  • Für Verbraucher mit gewöhnlichem Aufenthalt in der EU gilt dies nur, soweit der gewährte Schutz nicht durch zwingende Bestimmungen des Rechts des Wohnsitzstaates entzogen wird.

13. Schlussbestimmungen

Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

3. Offer & Contract Formation

  • The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.

  • By clicking the "Buy now" button, you submit a binding purchase offer.

  • The confirmation of receipt of your order is sent automatically by email immediately after submission.

  • The purchase contract is concluded when we accept your order via email or dispatch the goods.

4. Production & Shipping via Printful

  • Physical products are produced on-demand by our partner Printful and shipped directly by Printful or their logistics partners.

  • Production and delivery times may vary and are outside our direct control.

  • Customers are responsible for any customs duties, import taxes, or related fees for international deliveries.

5. Digital Products (e.g., Songs, Downloads)

  • For digital content, the statutory right of withdrawal expires once we start fulfilling the contract and you have expressly agreed to this (Art. 16 lit. m EU Consumer Rights Directive).

  • Digital products are usually available for download immediately after payment is received.

6. Prices & Payment

  • All prices are stated in Euros (€) plus shipping costs.

  • In accordance with § 19 German VAT Act (Kleinunternehmerregelung), no VAT is charged.

  • Accepted payment methods are displayed during the checkout process (e.g., PayPal, credit card, Stripe).

  • For international orders, currency conversion fees or bank charges may apply.

7. Delivery

  • Delivery times depend on the production and shipping location (Printful) and are displayed at checkout.

  • Worldwide delivery is available unless restricted by law.

8. Right of Withdrawal / Returns

  • For physical products, the statutory right of withdrawal of 14 days applies, starting from the day you receive the goods.

  • Exceptions:

    • Products made to customer specifications (e.g., personalised merchandise).

    • Digital products once the download has started.

9. Warranty & Liability

  • Statutory warranty rights apply.

  • We are fully liable for intent and gross negligence, as well as for injury to life, body, and health.

  • In cases of slight negligence, we are only liable for foreseeable, typical contractual damages.

10. Data Protection

  • The processing of personal data is carried out in accordance with our Privacy Policy.

  • For production, shipping, and payment processing, data will be shared with our partners (e.g., Printful, payment providers).

11. Copyrights

  • All content (texts, images, music, designs) is protected by copyright.

  • Downloads are for personal use only and may not be redistributed.

12. Applicable Law & Dispute Resolution

  • German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  • For consumers with their habitual residence in the EU, this applies only to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country of residence.

13. Final Provisions

If individual provisions of these Terms & Conditions are invalid, the validity of the remaining provisions remains unaffected.
